In this Privacy Policy (“Policy”), we describe how AbilityStack, Inc. (“AbilityStack,” “we,” “us,” or “our”) collects, uses, and protects the information that we obtain about visitors to our website, suite of products and users of our mobile Applications (the “App”) and the services available through our Site, products and App (collectively, the “Services”).

 

This Policy describes how we use “your” information. To understand which of our uses of information are actually applicable to you and your information see the following useful definitions.

 

You may be a(n):

Customer – an entity, or person representing an entity that has an agreement in place with AbilityStack under which we provide you with SaaS or Subscription Services, or is visiting our Site to purchase SaaS or Subscription Services.

End-User – a person with a user account to one of our products of our SaaS or Subscription Services.

Visitor – a person who is visiting our website or has expressed an interest in our products or services by filling in a contact form or sign-up sheet in relation to an article or event or has had conversations about our products with our sales team and provided them with your details.

We collect, retain and use personal data for our professional business purposes only. We limit the personal data we collect to that which we believe is appropriate and necessary to manage user needs, provide our services and comply with applicable laws.

We may collect personal information about when you visit our websites, contact us via web, or request information about our contingent workforce management product. When visiting our websites, we may collect personal data such as name and contact details (which may include place of employment).

We use many sources of information to help us meet our needs and the needs of our customers and users.

AbilityStack maintains personal data about contingent workers employed or supplied by third parties such as temporary employment agencies and other labor providers, and independent contractors.

Names and contact data: may include your first and last names, personal and/or professional email addresses, physical addresses, phone numbers, and emergency contact information.

National identifiers: such as your national identification, passport information, citizenship, residency, work permit, social security number, or other government identification number.

Employment Information: such as the position you hold now or in the past, job title(s), work location, assignment start and end dates, educational background, history with the company, areas of expertise, reviews, records relating to holiday and other leave, working time records, billing records and other management records.

Demographic data: may include your date of birth, gender, and at times may include more sensitive personal data including race, ethnicity, military veteran status, disabilities, union affiliation, and parental status.

Device-specific information: such as your hardware model, operating system version, unique Device identifiers and mobile network information. For purposes of this Privacy Policy, a "Device" is any computer or handheld used to access one of the products, including without limitation a desktop, laptop, mobile phone, tablet, or other consumer electronic Device.

Log information recorded when you use our Site including your Device, its software, and Device identifiers and mobile network information. For purposes of this Privacy Policy, a "Device" is any computer used to access the Site, including without limitation a desktop, laptop, mobile phone, tablet, or other consumer electronic Device. Your activity using the Site. This may include:

  • The Device’s Internet Protocol (“IP”) address;
  • Identification numbers associated with your Devices;
  • Device event information such as crashes, system activity and hardware settings;
  • Locale preferences;
  • Application activity such as app upload, app download, app installation, app uninstallation, app start, app play duration, app stop, app crashes, app network activity and app resource consumption;
  • Date and time stamps associated with transactions;
  • System configuration information;



We can use this information for a variety of purposes, which vary by jurisdiction. These reasons may include:

  • Where necessary to comply with our legal obligations. For example, we may collect and process this information in order to comply with antidiscrimination laws and government reporting requirements;
  • To monitor and ensure diversity and equality of treatment and opportunity; and
  • To provide accommodations during the application and hire process. Where the collection and processing of this data is not required by law, the provision of this data is completely voluntary, and you can decide whether to provide it or not.



For customers and our staff employees: Limited personal data is kept on the products for users such as MSP, Hospital and AbilityStack staff employees. This may include: Names and contact data may include your first and last names, personal and/or professional email addresses, physical addresses, phone numbers, and emergency contact information.

Anonymized Data and Aggregated Statistical Information: AbilityStack may use anonymized data and aggregated statistical information to enhance its services and in connection with other services AbilityStack may offer to its customers. We also may use the aggregated and statistical data derived from the operation of our VMS and other products, including, without limitation, the number of records in the system, the number and types of transactions, configurations, and reports processed in the system and the performance results for the system for purposes of providing or improving service, benchmarking service performance, preparing statistics and system metrics, and marketing, or to provide other services that AbilityStack may offer to its customers; provided however, that AbilityStack’s use of anonymized data and/or aggregated statistical information will not reveal personal data to any third party.

 

 

THE REASONS WE PROCESS YOUR PERSONAL DATA

We collect and process your personal data for the following purposes:

  • As reasonably necessary to serve the legitimate interests of AbilityStack and its clients.
    • For example, AbilityStack and its client have a legitimate interest in locating qualified individuals for possible employment. There is also a mutual interest for job seekers to engage with our products and its client to find new job opportunities that may interest them or present a better fit for their professional skills.
  • As necessary for the creation and performance of an employment contract or working relationship between you and AbilityStacks' client.
    • To any of our related AbilityStack’s companies.
  • We may use your personal data to comply with the law, including collecting and revealing personal data as required (e.g., for minimum wage, hours worked, health and safety, anti-discrimination laws, and global mobility), to respond to judicial authorities, or to exercise or protect AbilityStack’s and/or its client's legal rights. Failure to provide your personal data when requested may prevent us from being able to carry out these tasks and/or comply with our legal obligations. We will only use your personal data for the purposes for which it was collected, unless we reasonably consider that we need it for another purpose that is compatible with the original purpose and there is a legal basis for further processing.

We do not:

  • Sell your personal data to any third parties.
  • Collect or process personal data of persons who are less than 16 years old.

AbilityStack is committed to keeping your personal information secure. To help protect your personal data from unauthorized access, use, or disclosure, we employ a range of security technologies and procedures. For example, we store your personal information on computer servers with restricted access that are housed in secure facilities, and we encrypt some highly confidential or sensitive personal information when we send it.



Where We Store and Process Data

AbilityStack works on a global scale, so personal data may be transmitted to countries other than those where it was obtained. Since we are based in the United States, we regularly move information gathered in other countries to the United States for processing. We will ensure that the transfer of your personal data to another country complies with all relevant laws and regulations.
